The Federal Fair Debt Collection Practices Act and state laws govern the conduct of banks, student loan companies, and debt collectors that collect debts from consumers. Debt collectors are required to comply with these laws. If they break these laws, they can be required to pay money to the consumer.

My Debt Collection Harassment Practice has two goals. First, I will stop the debt collectors from calling you anymore. Under the Fair Debt Collection Practices Act, a debt collector cannot call a consumer directly if the consumer is represented by an attorney. As soon as I take your case, I will instruct the debt collectors never to call you again.

My second goal is to recover you money from the debt collectors if they broke the law. Did you know that it is generally illegal to call a consumer’s cell phone using an autodialer without the consumer’s consent? If a debt collector called your cell phone using an autodialer without your consent, they may owe you up to $1,500 for each and every call. As soon as I take your case, I will work with you to determine whether debt collectors have called you using an autodialer. I will then work to recover you the maximum possible reward from every single debt collector.

There are many other rules that debt collectors, banks, and student loan companies must comply with.

Most importantly, debt collectors cannot harass or abuse you. If you have been harassed by a debt collector, that debt collector may owe you $1,000.00 under the Fair Debt Collection Practices Act.

  • Debt collectors cannot call you repeatedly with intent to annoy you.
  • Debt collectors cannot lie to you
  • Debt collectors cannot call you before 8:00 a.m. or after 9:00 p.m.
  • Debt collectors cannot tell your family, friends or employer about your debt.
  • Debt collectors cannot collect debts that you did not agree to pay.
If any debt collector committed any of these acts against you, then you may be entitled to $1,000.00 from the debt collector.
